Eligibility and Geographic Restrictions

You must be at least 18 years old and a resident of the United States to use Collect. By using the Services, you represent and warrant that:

• You are 18 years of age or older
• You are a resident of the United States
• You are legally capable of entering into binding agreements
• Your use of the Services does not violate any applicable law or regulation

BINDING ARBITRATION AND CLASS ACTION WAIVER

Agreement to Arbitrate: You and Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be settled by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You and Company agree that each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

Arbitration Rules: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. For California residents, arbitration shall take place in California. For all other U.S. residents, arbitration may take place in your state of residence or virtually.

Opt-Out Right: You may opt out of this arbitration provision by sending written notice to contact.collectdev@gmail.com within 30 days of first using the Services. The notice must include your name, address, and a clear statement that you wish to opt out of the arbitration provision.

Account & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at contact.collectdev@gmail.com if you suspect unauthorized access.

You may not create more than one account. We reserve the right to suspend access or terminate accounts if abuse is detected, including but not limited to creating multiple accounts, submitting false information, or violating these Terms.

Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Services. Continued use of the Services after updates means you accept the revised Terms.

Use of Services

You may use Collect only for lawful, personal, and non-commercial purposes. You agree not to:

• Violate any federal, state, or local law or regulation
• Submit false, misleading, or fraudulent information
• Submit information under penalty of perjury that you know to be false
• Engage in spamming, scraping, or unauthorized data collection
• Interfere with the functioning of the Services
• Use automated tools or resell access without written consent
• Access the Services from outside the United States
• Use the Services for any purpose other than filing legitimate settlement claims

Nature of Services - Filing Assistant Only

Collect provides administrative assistance for filing class action settlement claims and individual arbitration claims:

• You do not need Collect to file claims; you can submit directly to settlement administrators
• We are not affiliated with any law firm, settlement administrator, court, or defendant
• We do not evaluate the merits of claims or provide legal opinions
• We are not responsible for claim outcomes, processing timelines, or payment amounts
• All legal decisions remain solely with you or your chosen legal counsel

Your Responsibility: You are solely responsible for reviewing all information before submitting claims. You must determine your own eligibility and the accuracy of all information provided.

Fees & Auto-Renewal

Collect charges subscription fees for access to our filing assistance services. Pricing and subscription terms are displayed at the time of purchase. All fees are in U.S. Dollars (USD).

By subscribing, you agree to automatic renewal unless cancelled. You may cancel at any time through your account settings or by contacting contact.collectdev@gmail.com. We will provide clear renewal terms and cancellation instructions.

Refund Policy

All subscription fees are generally non-refundable once services have been provided. Refund requests will be evaluated on a case-by-case basis at our sole discretion.

If you initiate a chargeback without first contacting our support team, your access to the Services may be permanently terminated.

Data & Privacy

We collect and use your data in accordance with our Privacy Policy and applicable U.S. federal and state privacy laws. You may request data deletion as described in our Privacy Policy by emailing contact.collectdev@gmail.com.

Disclaimers

User Responsibilities and Representations

By using our Services, you represent, warrant, and agree that:

• All information you provide is true, accurate, and complete
• You meet all eligibility requirements for claims you submit
• You understand that submitting false information may constitute perjury
• You are solely responsible for determining your eligibility for settlements
• You will not submit duplicate claims for the same settlement
• You are solely responsible for any taxes on settlement payments
• You understand we provide no legal advice or guarantees

Limitation of Liability

Damages Cap: Our total liability to you for any and all claims shall not exceed the greater of: (a) the subscription fees you paid to us in the twelve (12) months preceding the claim, or (b) $100 USD.

No Liability for Third-Party Actions: We are not liable for actions, decisions, or payments by settlement administrators, courts, law firms, or other third parties.

Indemnification

You agree to indemnify, defend, and hold harmless Company, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms or applicable law
• Your false, misleading, or fraudulent submissions
• Your submission of information under penalty of perjury
• Third-party claims related to your settlement claims
• Any breach of your representations and warranties herein

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Delaware.

Termination

We may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms
• Submission of false or fraudulent information
• Abuse of the Services
• Failure to pay subscription fees

Upon termination, your right to use the Services ceases immediately. Sections regarding arbitration, limitation of liability, indemnification, and other provisions that by their nature should survive will remain in effect.

Miscellaneous

• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign these Terms without notice.
• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Company.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
• Waiver: Our failure to enforce any provision does not constitute a waiver of that right.
• Headings: Section headings are for convenience only and do not affect interpretation.
