These Terms of Use (“Terms”) govern your access to and use of Collect, including our mobile application, website, and all associated services and content (collectively, the “Services”). These Terms form a binding agreement between you and Collect (“Company,” “we,” or “us”).

US Residents Only
Collect is exclusively available to residents of the United States. By using our Services, you represent that you are located within the United States and subject to U.S. jurisdiction.

Geographic Limitation
Our Services are exclusively available to U.S. residents. Access from outside the United States is prohibited. We reserve the right to restrict access based on geographic location.

This section affects your legal rights, including your right to file a lawsuit in court and have a jury trial. You have the right to opt out of this arbitration provision as described below.
Agreement to Arbitrate: You and Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be settled by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
Class Action Waiver: You and Company agree that each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.
Arbitration Rules: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. For California residents, arbitration shall take place in California. For all other U.S. residents, arbitration may take place in your state of residence or virtually.
Opt-Out Right: You may opt out of this arbitration provision by sending written notice to contact.collectdev@gmail.com within 30 days of first using the Services. The notice must include your name, address, and a clear statement that you wish to opt out of the arbitration provision.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at contact.collectdev@gmail.com if you suspect unauthorized access.
You may not create more than one account. We reserve the right to suspend access or terminate accounts if abuse is detected, including but not limited to creating multiple accounts, submitting false information, or violating these Terms.
Account Security
Your account is protected with industry-standard security measures. You are solely responsible for maintaining the security of your account credentials.
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Services. Continued use of the Services after updates means you accept the revised Terms.

Many settlement claims are submitted under penalty of perjury. Submitting false information may result in criminal prosecution under federal and state perjury laws.

Collect is not a law firm and does not provide legal advice, legal representation, or legal services. We are solely a filing assistance service.

Collect charges subscription fees for access to our filing assistance services. Pricing and subscription terms are displayed at the time of purchase. All fees are in U.S. Dollars (USD).
By subscribing, you agree to automatic renewal unless cancelled. You may cancel at any time through your account settings or by contacting contact.collectdev@gmail.com. We will provide clear renewal terms and cancellation instructions.
No Success Guarantee
Subscription fees are for filing assistance services only. We make no guarantees about claim success, approval rates, payment amounts, or timelines.
All subscription fees are generally non-refundable once services have been provided. Refund requests will be evaluated on a case-by-case basis at our sole discretion.
If you initiate a chargeback without first contacting our support team, your access to the Services may be permanently terminated.
We collect and use your data in accordance with our Privacy Policy and applicable U.S. federal and state privacy laws. You may request data deletion as described in our Privacy Policy by emailing contact.collectdev@gmail.com.

SUNKISS AI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUNKISS AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
Damages Cap: Our total liability to you for any and all claims shall not exceed the greater of: (a) the subscription fees you paid to us in the twelve (12) months preceding the claim, or (b) $100 USD.
No Liability for Third-Party Actions: We are not liable for actions, decisions, or payments by settlement administrators, courts, law firms, or other third parties.
You agree to indemnify, defend, and hold harmless Company, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Delaware.
Consumer Protection
Nothing in these Terms limits your rights under applicable consumer protection laws. Where state consumer laws provide greater protection, those laws will apply.
We may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include:

We are not a law firm, do not provide legal advice, and are not affiliated with any courts, settlement administrators, or defendants. We assist with filing settlement claims and arbitration demands but do not guarantee outcomes, represent users, or process payments. Settlement payments are handled by administrators or opposing parties.
